Terms of Service

Welcome to Maybee. Maybee (also referred to in this agreement as the "Application", the "App", or the "Service") is a mobile entertainment application published by NATUREAI TECHNOLOGY PTE. LTD. (referred to herein as "NATUREAI", the "Company", "we", "us", or "our"). The App provides users with access to hundreds of professionally authored, AI-enhanced anime-style interactive stories.

These Terms of Service (these "Terms") govern your access to and use of the Service. By creating an account, downloading, installing, or otherwise using the Service, you confirm that you have read, understood, and agreed to be legally bound by these Terms, by our Privacy Policy, and by our End User License Agreement (the "EULA"), each of which is incorporated by reference into these Terms. If you do not agree with any of these documents, you must not access or use the Service.

1. Eligibility

You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction of residence (whichever is higher), to use the Service. By accessing the Service, you represent and warrant that you meet this minimum age requirement. The Service is not directed to children, and NATUREAI does not knowingly collect personal data from individuals under the age of majority. We may require you to confirm your age during registration and may, at our sole discretion, suspend or terminate any account if we reasonably believe that the user does not meet the minimum age requirement.

You further represent and warrant that you are not located in, and are not a resident or national of, any jurisdiction that is the subject of comprehensive sanctions administered by the United States Office of Foreign Assets Control, the European Union, or the United Nations, and that you are not listed on any restricted-party list maintained by those authorities.

2. Account Registration and Security

In order to access the Service, you must create an account. You may register an account with us by: Apple ID, Google account, or a valid email address. In all cases NATUREAI will collect and process only the minimum information necessary to create and operate your account, as described in our Privacy Policy.

During the registration, you will be asked to provide your date of birth. You agree to provide accurate, current, and complete information and to keep that information up to date.

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account, whether or not you authorized it. You agree to notify NATUREAI immediately of any unauthorized use of your account or any other breach of security.

Your account is personal to you. You may not sell, transfer, sublicense, or otherwise commercially exploit your account, and you may not allow any other person to use your account for any purpose. NATUREAI may, in its reasonable discretion, refuse registration, suspend, or terminate any account that violates these Terms or that we suspect of being used in connection with fraud, abuse, or breach of applicable law.

3. Charms

The Service uses a virtual, in-application token called "Charms". Charms function as a license to access interactive features within the Service (in particular, to send text messages to characters and to unlock certain narrative branches) and have no monetary value outside the Service. Charms are not legal tender, are not redeemable for cash or any monetary instrument, are not transferable between accounts or to other persons, and are not refundable except as required by the refund policies of the platform through which they were purchased.

Charms may be obtained through in-application purchases, which are processed exclusively through the Apple App Store and are subject to Apple's Licensed Application End User License Agreement, the Apple Media Services Terms and Conditions, and any applicable App Store usage rules. NATUREAI does not process payments directly and does not have access to your payment card details.

4. Purchases and Refunds

All in-application purchases made within the Service are processed by Apple Inc. through the Apple App Store and are governed by the Apple Media Services Terms and Conditions. All questions relating to billing, payment methods, refunds, returns, and chargebacks must be directed to Apple Support. NATUREAI is not in a position to grant refunds directly, and any refund granted by Apple will be processed in accordance with Apple's then-current policies. Sales of Charms and other digital content within the Service are final once the digital item has been delivered to your account, except where a mandatory refund right exists under the law of your jurisdiction. Nothing in this section is intended to override any non-waivable consumer rights you may have under applicable law.

5. AI-Generated Content and Reporting

All storyline, images, character design, character dialogue, narrative passages, story branches, and other expressive content within the Service are produced, in whole or in part, by artificial intelligence systems. NATUREAI clearly indicates, within the user interface, that each story and each character interaction is AI-generated. You acknowledge and agree that AI-generated output may contain factual errors, inaccuracies and may not reflect the views of NATUREAI or its licensors, and should not be relied upon for any purpose requiring absolute accuracy, including but not limited to medical, legal, financial, or safety-critical purposes.

If you encounter any AI-generated output that you consider to be unlawful, harmful, misleading, or otherwise objectionable, you may report it directly within the Application using the in-app reporting tool, or by writing to us at maybee88866@gmail.com. Reports submitted through these channels are reviewed by moderators and are processed no later than required by law. NATUREAI reserves the right, but undertakes no obligation, to remove, restrict, or modify AI-generated content that it reasonably considers to be in breach of these terms, applicable law, or its content policies.

6. User’s Conduct

You agree to use the Service only for lawful purposes and in a manner that respects the rights of other users and third parties. In particular, you agree not to use the Service to engage in, promote, or facilitate any of the following activities:

• the violation of any applicable law, regulation, or third-party right;
• the upload or transmission of input text that is unlawful, threatening, defamatory, harassing, hateful, sexually explicit, or that incites violence;
• any attempt to reverse engineer, decompile, or otherwise attempt to extract the source code or underlying AI models of the Service;
• any attempt to interfere with or disrupt the integrity or performance of the Service or the data contained therein;
• any attempt to access the Service through automated means, including bots, scrapers, or scripted readers, other than through interfaces we expressly provide; or
• any attempt to circumvent, manipulate, or otherwise exploit bugs, errors, or undocumented behaviors of the Service for personal advantage, including any attempt to obtain Charms, gain free subscriptions or other digital items by fraudulent means.

7. Intellectual Property

The Service, including the Maybee name and logo, the visual design, the underlying software code, the user interface, the story concepts, the character designs and names, the dialogue generated by the AI models, and all other trademarks, service marks, and copyrightable works associated with the Service, are and shall remain the exclusive property of NATUREAI or its licensors. Nothing contained in these Terms should be construed as granting you, by implication, estoppel, or otherwise, any license or right to use any of the foregoing except as expressly permitted by these Terms. Depending on the jurisdiction, the level of protection on AI-generated work may vary.

Subject to your compliance with these Terms, NATUREAI grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your own personal, non-commercial entertainment.

8. DMCA Compliance

We respect the intellectual property rights of others. If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit a DMCA notification to our Designated Copyright Agent by email (maybee88866@gmail.com, in subject line, please specify: Re: DMCA notification). Your notification must include the following information:

• Identification of the copyrighted work that you claim has been infringed, or, if multiple works are involved, a representative list of such works.
• Identification of the material that is claimed to be infringing and where it is located within the App (e.g., a link to the infringing content or other description to help us locate it).
• Your contact information, including your full name, mailing address, phone number, and email address.
• A statement that you have a good-faith belief that the use of the copyrighted material in question is not authorized by the copyright owner, its agent, or the law.
• A statement, made under penalty of perjury, that the information provided in the notification is accurate and that you are authorized to act on behalf of the copyright owner.
• Your physical or electronic signature.

Upon receiving a valid DMCA notification via email, we will acknowledge receipt and confirm acceptance of your request within five (5) business days. We will inform you of the results of our investigation and our decision within 15 business days after you receive our confirmation of acceptance of your request.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis. YOU UNDERSTAND AND ACKNOWLEDGE THAT THE SERVICE IS PROVIDED IN A FORM CONSISTENT WITH EXISTING TECHNOLOGY AND CONDITIONS, THAT WE CANNOT GUARANTEE THAT IT IS FREE FROM DEFECTS, AND THAT WE DO NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES FOR THE SERVICE, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR CERTAIN PURPOSES, QUALITY, STABILITY, CORRECTNESS, TIMELINESS, COMPLETENESS, CONSISTENCY AND SAFETY. HOWEVER, WE UNDERTAKE TO CONTINUOUSLY IMPROVE THE QUALITY OF OUR SERVICES.

THE SERVICE IS NOT A MEDICAL, PSYCHIATRIC OR ANY OTHER PROFESSIONAL ADVICE PROVIDER, NOR SHOULD OUR SERVICES BE CONSIDERED MEDICAL, MENTAL HEALTH OR OTHER PROFESSIONAL SERVICES. ONLY YOUR PHYSICIAN, HEALTHCARE PROVIDER OR OTHER PROFESSIONALS CAN DO THAT. THEREFORE, WE MAKE NO CLAIMS, REPRESENTATIONS OR GUARANTEES THAT OUR SERVICE WILL PROVIDE A THERAPEUTIC OR OTHER PRACTICAL BENEFIT.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall NATUREAI, its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including, without limitation, damages for loss of profits, revenue, goodwill, use, data, or other intangible losses, arising out of or in connection with your access to, use of, or inability to use the Service, even if NATUREAI has been advised of the possibility of such damages.

Where liability cannot be excluded but may be limited, the aggregate liability of NATUREAI and its affiliates, officers, directors, employees, agents, suppliers, and licensors for any and all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you have actually paid to NATUREAI for use of the Service in the twelve (12) months immediately preceding the event giving rise to the liability, or (b) one hundred United States dollars (US$100).

Nothing in this section is intended to exclude or limit liability that cannot be excluded or limited under applicable law, including, in the European Union, liability for death or personal injury caused by negligence, for fraud, or for fraudulent misrepresentation.

11. Suspension and Termination

You may terminate your account at any time by using the in-app account-deletion function. We do not accept the request for termination by email or contacting our support team. Upon termination, your right to use the Service ceases immediately. Your remaining Charms will be forfeited and are not redeemable for cash or any other form of compensation, except where mandatory law requires otherwise.

NATUREAI may suspend, restrict, or terminate your access to the Service at any time, with or without prior notice, if we reasonably believe that you have breached these Terms, that your continued use of the Service poses a risk to NATUREAI, to other users, or to third parties, or that we are required to do so by applicable law or by a competent authority. Termination will not affect any rights or obligations that, by their nature, are intended to survive, including provisions relating to intellectual property, disclaimers, limitation of liability, dispute resolution, and governing law.

12. Governing Law and Dispute Resolution

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of Singapore, without giving effect to any conflict-of-law provisions. Notwithstanding the foregoing, consumers located in the European Economic Area, the United Kingdom, or Switzerland retain the protection of the mandatory provisions of the law of their country of habitual residence.

The parties shall first attempt to resolve any dispute arising out of or relating to these Terms through good-faith negotiation. If the dispute is not resolved within thirty (30) days, either party may submit the dispute to the competent courts of Singapore, except those consumers located in the European Economic Area, the United Kingdom, or Switzerland may also bring claims against NATUREAI in the courts of their country of habitual residence and may, where the laws of that country so provide, rely on the protections of those laws.

Nothing in this section limits your right to bring a claim before a competent consumer-protection authority or data-protection authority in your jurisdiction, including, for European Union residents, the right to lodge a complaint with the supervisory authority under Article 77 of the General Data Protection Regulation.

13. Changes to these Terms

NATUREAI may revise these Terms from time to time. Where a revision is material, we will provide reasonable advance notice within the Application, by email, or by other means reasonably calculated to reach you. The notice will indicate the date on which the revised Terms will take effect, which will not be sooner than thirty (30) days from the date of notice unless the change is required by law. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms. If you do not agree to a revision, you must stop using the Service and may close your account.

15. Miscellaneous

These Terms, together with the Privacy Policy and the EULA, constitute the entire agreement between you and NATUREAI with respect to the Service and supersede all prior or contemporaneous communications and proposals on the same subject matter. If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect. The failure of NATUREAI to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. You may not assign these Terms without the prior written consent of NATUREAI; NATUREAI may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
